General Terms and Conditions of Sale

These General Conditions concern the purchase of products and services, carried out remotely via the internet on the website http://www.ldtshop.it owned by Salvatore Leone, hereinafter L'ISOLA DEL TESORO DI LEONE SALVATORE, with registered and operational office in Via Libertà, 67 - 76121 BARLETTA (BT), VAT Number IT 07396380722 , tax code LNESVT77H20A883V, R.E.A. number - 554663.

Acceptance of the general terms and conditions of sale

1) The contract entered into between L'ISOLA DEL TESORO DI LEONE SALVATORE and the Customer shall be understood as concluded upon the acceptance, even partial, of the order by L'ISOLA DEL TESORO DI LEONE SALVATORE. This acceptance is considered tacit, unless otherwise communicated to the Customer by any means. By placing an order in the various ways provided, the Customer declares to have read all the information provided to them during the purchase procedure, and to accept in full the general and payment conditions described below.

2) If the Customer is a consumer (i.e., a natural person who purchases the goods for purposes not related to their professional activity), once the online purchase procedure is completed, they will print or save an electronic copy and in any case keep these general conditions of sale, in compliance with the provisions of Articles 3 and 4 of Legislative Decree 185/1999 on distance selling.

3) Any right of the Customer to damages or compensation is excluded, as is any contractual or non-contractual liability for direct or indirect damages to persons and/or property, caused by the non-acceptance or failure to process, even partially, an order.

Purchase methods

4) The Customer may only order the products present in the electronic catalog of L'ISOLA DEL TESORO DI LEONE SALVATORE at the time the order is placed and viewable online at the address http:/www.ldtshopit, as described in the relevant information sheets. It is understood that the image accompanying the descriptive sheet of a product may not be perfectly representative of its characteristics but may differ in color, size, and accessory products present in the image.

5) The correct receipt of the order is confirmed by L'ISOLA DEL TESORO DI LEONE SALVATORE by an email reply, sent to the email address provided by the Customer. The response is generated automatically by the system and cannot be considered as acceptance of the order itself, but only as confirmation of its receipt. 6) In case of non-acceptance of the order, L'ISOLA DEL TESORO DI LEONE SALVATORE will promptly notify the Customer.

Prices and payment methods

7) All prices and rates are expressed in Euro, VAT included. Upon shipment, a tax invoice will be issued, which will be delivered together with the goods. Payments can be made via:

PayPal

Advance bank transfer.

7.1) Credit card In cases of purchase of goods with Credit Card payment method, simultaneously with the conclusion of the online transaction, the relevant bank will authorize the credit for the amount related to the purchase made.

7.2) In the event of order cancellation, either by the Customer or in the case of non-acceptance of the same by L'ISOLA DEL TESORO DI LEONE SALVATORE, the cancellation of the transaction and the release of the committed amount will be requested simultaneously by L'ISOLA DELTESORO DI LEONE SALVATORE. Release times for some types of cards depend exclusively on the banking system and can reach their natural expiration (typically 24-25 days from the authorization date). Once the transaction has been canceled, in no case can L'ISOLA DEL TESORO DI LEONE SALVATORE be held liable for any direct or indirect damages caused by the delay in the release of the committed amount by the banking system.

7.3) L'ISOLA DEL TESORO DI LEONE SALVATORE reserves the right to request additional information from the Customer (e.g., fixed telephone number) or the submission of a copy of documents proving the ownership of the Card used. In the absence of the required documentation, L'ISOLA DEL TESORO DI LEONE SALVATORE reserves the right not to accept the order.

7.4) For greater guarantee and security of the Customer, at no time during the purchase procedure is L'ISOLA DEL TESORO DI LEONE SALVATORE able to know the information regarding the buyer's credit card, which is transmitted via a protected connection directly to the website of the bank managing the transaction. No IT archive of L'ISOLA DEL TESORO DI LEONE SALVATORE will store such data. In no case can L'ISOLA DEL TESORO DI LEONE SALVATORE be held liable for any fraudulent and improper use of credit cards by third parties upon payment of products purchased on the site http://www.ldtshop.it

7.5)Payment with PayPal By selecting the PayPal payment type, the Customer is redirected to a page of the PayPal site where they can make the payment by entering their email address and password. The Customer's financial data is not shared with L'ISOLA DEL TESORO DI LEONE SALVATORE but is managed directly by PayPal

7.6) In case of cancellation of the order or non-acceptance by L'ISOLA DEL TESORO DI LEONE SALVATORE, the amount is refunded to the Customer's PayPal account and L'ISOLA DEL TESORO DI LEONE SALVATORE cannot be held liable for delays and/or damages caused during the refund phase.

7.7)Advance bank transfer
Payment can be made via advance bank transfer. The Customer will receive an email with the exact amount to pay and all the necessary details for making the transfer.

The amount requested is always and only for the products actually available.

For this reason, payment must not be made before receiving instructions from our customer service team.

The bank transfer receipt must be sent via email to lisolatesoro@libero.it to avoid payment reminders or delays in credit processing that could lead to the cancellation of the order. The order will be considered cancelled if the bank transfer receipt is not received within 3 working days. Shipment of the goods takes place exclusively after receipt of the funds.

Delivery methods and costs

8) For the issuance of the invoice, the information provided by the Customer at the time of the order shall prevail. No changes to the invoice will be possible after its issuance.

9) Delivery costs are borne by the Customer, in the amount indicated in the order confirmation notice. Payment for the goods by the Customer shall be made using the method chosen at the time of the order.

10) For the delivery of the goods, the presence of the Customer or an authorized representative at the recipient's address indicated in the order is required. At the time of delivery of the goods by the courier, the Customer is required to check: > that the number of packages delivered corresponds to what is indicated on the transport document > that the packaging is intact, not damaged, nor wet or otherwise altered, including the sealing materials (adhesive tape or plastic strapping). Any damage to the packaging and/or the product or a mismatch in the number of packages or details must be immediately contested by noting a specific reservation on the courier's delivery receipt. Once the courier's document is signed, the Customer may not raise any dispute regarding the external characteristics of what has been delivered.

11) Without prejudice to the thirty-day period from receipt of the order, the times established for the delivery of the goods are to be considered indicative. There is no provision for a prior phone call to the Customer by the courier.

12) In the event of the Customer's absence, a second attempt or a phone contact by the courier is scheduled to arrange a re-delivery within the following 24 hours. In the event of a negative outcome for the re-delivery as well, L'ISOLA DEL TESORO DI LEONE SALVATORE will attempt to contact the Customer to define and potentially resolve the causes of the failed delivery. In the event of a negative outcome, the order will be considered cancelled due to the impossibility of completing the delivery. L'ISOLA DEL TESORO DI LEONE SALVATORE will notify the Customer of the cancellation via email. Any amount already paid by the Customer will be refunded to them, deducting the costs incurred for the delivery attempts.

13) If unable to deliver the ordered goods following their subsequent unavailability, even temporarily, L'ISOLA DEL TESORO DI LEONE SALVATORE will promptly notify the Customer via email. Any amount already paid by the Customer will be refunded as soon as possible, and in any case no later than thirty days from receipt of the purchase order.

Delivery of goods

14) L'ISOLA DEL TESORO DI LEONE SALVATORE will ship the products ordered by the Customer, via courier, to the address indicated by the same at the time of the order, indicatively within 48 working hours from the acceptance of the order. Delivery in Italy generally takes place within 5 working days, and in other countries within 10 working days.

15) The courier's delivery time is Monday to Friday from 9:00 am to 5:00 pm. Orders received on Saturday and Sunday will be processed on the following Monday; orders received during public holidays will be processed on the next working day. In any case, delivery times are provided for indicative purposes only and are therefore not binding.

16) The courier is responsible for delivery. L'ISOLA DEL TESORO DI LEONE SALVATORE undertakes to collect any reports of non-delivery or delayed delivery of the products and, if necessary, to assist the Customer in protecting their rights as per the law.

17) The appointed courier will make one delivery attempt during the day; if no one is home, they will leave a failed delivery notice containing a phone number to call.

18) Products purchased on the site can be delivered throughout Italy, including the islands, and in all foreign nations that are part of the list of served countries. For shipments to the territory of San Marino, Vatican City, Campione d'Italia, and Livigno, the recipient of the goods is responsible for the payment of taxes and customs duties provided by the regulations in force in the destination territory of the products.

Right of withdrawal

19) Pursuant to art. 64 of Legislative Decree no. 206/2005, if the Customer is a consumer (i.e., a natural person who buys goods for purposes unrelated to any business or professional activity carried out, or does not make the purchase by indicating a VAT reference number in the order form), they have the right to withdraw from the contract for any reason, without the need to provide explanations and without any penalty, subject to the provisions of the following articles 20, 21, 22.

20) To exercise the right of withdrawal, the Customer must send L'ISOLA DEL TESORO DI LEONE SALVATORE a communication to that effect within 10 working days from the date of receipt of the goods. This communication must be sent by registered letter with acknowledgment of receipt addressed to: Salvatore Leone, Via Libertà, 67 – 76121 Barletta. Once the notice of withdrawal is received, L'ISOLA DEL TESORO DI LEONE SALVATORE will communicate to the Customer - via email - the address to which to ship the goods, to be returned within 10 working days via courier, along with the return authorization number to be indicated on the courier's waybill.

21) The Customer must ship the product carefully packed in its original packaging, avoiding damage with adhesive labels or otherwise, and complete with everything originally contained, to the communicated address. Shipping costs for the return of the goods are borne by the Customer. The shipment, until the confirmation of receipt by L'ISOLA DEL TESORO DI LEONE SALVATORE , is under the responsibility and risk of the Customer. Upon receipt of the goods, L'ISOLA DEL TESORO DI LEONE SALVATORE will verify its integrity and refund the Customer the amount of the purchased product, excluding transport costs. The refund will be made via bank transfer to the current account indicated by the Customer or by credit to the credit card within thirty days of receipt of the return. In case of payment by the Customer via electronic money through the PayPal ® service, the refund will be made in accordance with the rules of the PayPal ® service.

22) The right of withdrawal is forfeited in the event of a lack of substantial integrity of the returned good, and thus, for example: > lack of the outer packaging and/or the original internal packaging; > absence of integral elements of the product (accessories, cables, manuals, parts, etc.); > damage to the product for reasons other than its transport; > abnormal storage condition. In the case of the Customer's forfeiture of the right of withdrawal, L'ISOLA DEL TESORO DI LEONE SALVATORE will return the purchased product to the Customer, charging the latter for the shipping costs.

Guarantees

23) All products sold by L'ISOLA DEL TESORO DI LEONE SALVATORE are covered by the manufacturer's conventional warranty and, for the Customer who is a consumer (natural person who buys goods for purposes unrelated to any business or professional activity, or makes the purchase without indicating a VAT reference number in the order form), also by the legal warranty for lack of conformity, as per articles 128-135 of Legislative Decree no. 206/2005. To take advantage of warranty assistance, the Customer must keep the invoice.

24) The legal warranty for the consumer Customer covers lack of conformity existing at the time of delivery of the goods, which has manifested itself within two years of the delivery of the goods themselves. The lack of conformity must be reported, under penalty of forfeiture, within two months from the date on which the consumer discovered the defect. Upon receipt of the notice, L'ISOLA DEL TESORO DI LEONE SALVATORE will contact the Customer to communicate the return procedure. L'ISOLA DEL TESORO DI LEONE SALVATORE will arrange for its courier to collect the product at no additional cost to the Customer. The product must be returned by the Customer, possibly in its original packaging, complete in all its parts (including any documentation and accessories: manuals, cables, etc.). In all cases, the placement of labels or adhesive tape directly on the original product packaging must be avoided. Once the product returned by the Customer has been checked, L'ISOLA DEL TESORO DI LEONE SALVATORE will provide for the replacement or repair and will proceed to ship the product itself, except as provided for by Art. 130 of Legislative Decree no. 206/2005.

Liability of auxiliary third parties

25) L'ISOLA DEL TESORO DI LEONE SALVATORE is not liable for the actions of third parties who, as independent auxiliaries, intervene in the management or performance of payment operations, delivery of goods, and any other operation connected to the execution of contracts concluded through the site http://www.ldtshop.it

Privacy

26) The personal data requested during the order submission phase are collected and processed in order to fulfill the express requests of the Customer and will in no case and for no reason be transferred to third parties. L'ISOLA DEL TESORO DI LEONE SALVATORE guarantees to its customers compliance with the legislation regarding the processing of personal data, governed by the privacy code referred to in Legislative Decree 196 of 30.06.03. The data controller is Salvatore Leone, Via Libertà, 67, 76121 BARLETTA (BT).

Complaints

27) Any complaint by the Customer must be addressed to L'ISOLA DEL TESORO DI LEONE SALVATORE by writing to Salvatore Leone, Via Libertà, 67 - 76121 BARLETTA (BT).

Applicable law and competent court

28) The sales contract between the Customer and L'ISOLA DEL TESORO DI LEONE SALVATORE is understood to be concluded in Italy and governed by Italian Law. For the resolution of civil and criminal disputes arising from the conclusion of this distance sales contract, if the Customer is a consumer, the territorial jurisdiction is that of the court of reference of his municipality of residence; in all other cases, the territorial jurisdiction is exclusively that of the Court of Trani (BT).
