GENERAL TERMS AND CONDITIONS OF SALE

L'ISOLA DEL TESORO DI LEONE SALVATORE, with registered office in Barletta, Via Libertà 67 — REA BA-554663, VAT number 07396380722 (hereinafter "LDTShop"), is the owner of the website www.ldtshop.it (hereinafter the "Site").

By using the Site's services, the Customer accepts these General Terms and Conditions of Sale (hereinafter the "Conditions") in their entirety and without reservation. The Conditions apply to every contract concluded between LDTShop and the Customer for the goods and services offered on the Site.

By placing an order, the Customer declares to have read, understood, and fully accepted these Conditions, including the payment methods.

To use the Site's services, it is necessary to create a personal profile by providing: full name, residential/domicile address, e-mail address, username, and password. LDTShop is not responsible for the accuracy of the information entered by the Customer.

These Conditions may be modified by LDTShop at any time. Changes are effective from the date of publication on the Site and apply to subsequent orders. The updated version is always available on the Site.

These Conditions are governed by Legislative Decree 70/2003 (e-commerce) and Legislative Decree 206/2005 as amended by Legislative Decree 170/2021 (consumer protection).

PURCHASING PROCEDURES AND CONCLUSION OF THE CONTRACT

To purchase, the Customer adds the desired Products to the cart, selects quantity and variant (where available), and sends the Order to LDTShop. Only Products present in the online catalog at the time of the Order can be purchased. The images of the Products are indicative and may differ in color, size, or accessories.

Receipt of the Order is confirmed via e-mail (the "Order Summary"), containing:

  • general and specific terms of the contract;
  • essential characteristics of the Product;
  • detailed price and payment methods;
  • any additional costs (e.g., shipping);
  • how to exercise the right of withdrawal.

The Customer must verify the accuracy of the data in the Order Summary and report any errors promptly. Changes to billing information are not possible after the invoice has been issued.

Each Order constitutes a contractual proposal by the Customer and becomes binding for LDTShop 3 days after receipt of the Order Summary, unless otherwise communicated. LDTShop reserves the right to cancel unreliable orders; in such cases, any payments already received will be fully refunded.

GIFT CARDS

LDTShop offers Gift Cards: prepaid vouchers that can be used on the Site or in-store. To purchase them, it is necessary to indicate the beneficiary's name, the amount, and the e-mail address. Once payment is confirmed, LDTShop will send an e-mail with the amount, identification code, and expiration date.

Gift Cards are valid for two years from the date of issuance. The unused balance upon expiration is non-refundable, unless otherwise provided by law. They can be used in one or more installments; the remaining balance can be checked on the Site. Gift Cards cannot be used to purchase other Gift Cards.

PAYMENT METHODS

The following payment methods are accepted:

Advance Bank Transfer
Products are reserved until proof of payment is received, which must be sent by e-mail within 3 working days of order acceptance. Shipping takes place only after actual credit, within 7 working days. Beyond these terms, the contract is considered terminated.
The purpose of the transfer must include the Customer's full name.

Credit Card
VISA, MasterCard, and Maestro are accepted via the secure server managed by Banca Sella. LDTShop does not have access to nor stores the Customer's credit card details.

PayPal
Upon conclusion of the Order, the Customer is redirected to the PayPal page. The amount is charged upon acquisition of the order. In case of cancellation, the refund is made to the PayPal account. LDTShop does not store the Customer's financial data.

Gift Card
The Customer enters the identification code before purchasing. If the remaining balance is insufficient, the difference can be settled using the other accepted payment methods.

PRODUCT AVAILABILITY AND ORDER PROCESSING

The online catalog includes over 3,000 products, many of which are ready for delivery. Orders are processed:

  • within the same day of payment (if received by 11:00 AM), or the next day, for Products in stock;
  • within 10 working days of payment, for Products requiring restocking.

The times indicated on the Site are purely indicative. LDTShop is not responsible for delays due to force majeure or events beyond its control. In case of a significant delay, the Customer may contact LDTShop at info@ldtshop.it to agree on a solution or exercise the right to terminate the contract pursuant to Art. 61 of Legislative Decree 206/2005.

COLLECTION OR DELIVERY METHODS

Products are shipped via express courier to the address indicated by the Customer. In-store collection (Barletta, Via Libertà 67) is available only in exceptional cases and subject to agreement with LDTShop.

Delivery is made to the door of the address indicated. Shipping costs are indicated on the Order screen. For available Products, delivery typically takes place within 48/72 hours from payment, from Monday to Friday (excluding holidays), from 9:00 AM to 7:00 PM.

Upon delivery, the Customer must check the integrity of the packaging and the correspondence of the parcels. Any anomalies must be reported to the Courier upon delivery and communicated to LDTShop within 8 days, with photographic documentation, via e-mail to lisolatesoro@gmail.com.

In case of non-delivery due to the recipient's absence, the Courier will attempt a second delivery. Once the storage period has elapsed, the Products will be returned to LDTShop with a charge of € 10.00 for handling fees.

Once the goods have been handed over to the Courier, LDTShop will provide the Customer with the tracking number to monitor the shipment.

SHIPPING COSTS

Shipping costs are borne by the Customer and vary depending on the destination and the weight of the Products. The amount is indicated on the Cart page before sending the Order and is summarized in the Order Summary.

RIGHT OF WITHDRAWAL

Pursuant to Arts. 52 et seq. of Legislative Decree 206/2005, the Consumer Customer has the right to withdraw from the Contract within 14 days of receipt of the Products, without having to provide reasons and without penalties.

Products must be returned within 14 days from the withdrawal notice to:

Conditions for valid withdrawal:

  • Products must be intact, unused, and in the complete original packaging;
  • possibility of returning individual Products from a single Order;
  • return costs borne by the Customer; LDTShop is not liable for damage or loss during the return transport.

 

Upon arrival, the Product will be inspected. In the event of damaged packaging due to the Customer's fault, LDTShop may apply a proportional reduction of the refund pursuant to Art. 57 para. 2 of Legislative Decree 206/2005.

The refund is made within 14 days of receipt of the Products, via reversal to the credit card or bank transfer. If, following the return, the remaining amount of the Order falls below € 59.00 (the threshold for free shipping), € 5.00 in shipping costs will be charged.

The right of withdrawal is excluded, pursuant to Art. 59 of Legislative Decree 206/2005, for custom-made, personalized, or sealed Products that cannot be returned for hygienic reasons once opened.

WARRANTIES

Pursuant to Legislative Decree 206/2005 as amended by Legislative Decree 170/2021, LDTShop guarantees the Products for any lack of conformity existing at the time of delivery and manifesting within two (2) years thereof.

For goods with digital elements (e.g., toys with connectivity or software components), the warranty extends to updates necessary to maintain the conformity of the product for the period reasonably expected by the consumer.

In case of a defect, the Consumer Customer is entitled to:

  • free repair or replacement;
  • an appropriate price reduction;
  • termination of the contract.

 

The defect must be reported within two (2) months of discovery. The presumption of pre-existence applies to defects manifesting within one year of delivery (Legislative Decree 170/2021). For non-consumer Customers, the warranty is one year and the defect must be reported within 8 days of discovery.

All Products comply with EU standards, including toy safety regulations (Directive 2009/48/EC, Legislative Decree 54/2011).

PRODUCT REPLACEMENT

LDTShop replaces, at its own expense, a Product or component in the following cases:

  • Product different from the one ordered (the Customer must not open the package and must contact LDTShop immediately);
  • Product not working due to manufacturing defects;
  • Product incomplete compared to what is indicated on the Site.

 

To activate the procedure, the Customer contacts LDTShop at lisolatesoro@gmail.com while retaining the proof of purchase. LDTShop reserves the right to examine the Product before accepting the return. If replacement is not possible, the refund will be made within 10 days of receipt of the Product.

JURISDICTION

These Conditions and the Contracts are governed by Italian law. For consumer Customers, the territorial jurisdiction is that of the place of residence of the Customer (Legislative Decree 206/2005). For all other cases, the exclusive jurisdiction is the Court of Trani.
